Peculiarities of the Criminalistics Characteristics of the Illegal Use for Profit of Humanitarian Aid, Charitable Donations or Free Assistance

The article is devoted to establishing the elements of the criminalistic characteristics of the illegal use for profit of humanitarian aid, charitable donations or free aid. It has been established that only those features that have a forensic significance and will contribute to increasing the effectiveness of the pre-trial investigation and trial of a criminal offense are subject to the forensic characteristics of the description.
It was concluded that the main elements of the forensic characteristics of the illegal use for profit of humanitarian aid, charitable donations or free aid should include: the subject of the criminal offense, the method, time, typical traces of the criminal offense, and the identity of the criminal.
In addition, the author states that the subject of criminal trespass in this case will be: funds, property, certain rights, work, services and other objects provided as humanitarian aid or charitable donations. And the ways of committing the investigated criminal offense include: sale of goods (items) of humanitarian aid; use of charitable donations, free assistance; conclusion of other transactions regarding the disposal of humanitarian aid property, charitable donations or free assistance.
It is noted that the following can act as a criminal: a citizen of Ukraine, a foreigner or a stateless person, an official or a legal entity.
