Abstract

The purpose of the article is to examine the specific features of legal regulation of cybersecurity in Ukraine under martial law, determine the current state of regulatory and legal framework in this area, and identify the main challenges and directions for its improvement in accordance with international standards.

The methodological basis of the research consists of general scientific and special legal methods, including systemic-structural, formal-legal, comparative-legal methods, as well as the method of analysis of regulatory legal acts, which enabled a comprehensive study of the functioning of the national cybersecurity system under conditions of military threats.

The article analyzes the essence of the concept of “cybersecurity” and its role in the national security system of Ukraine. The main regulatory legal acts governing the field of cyber protection are examined, including the specifics of legislative development during 2022–2025 under the influence of the full-scale armed aggression of the Russian Federation. The study identifies the peculiarities of legal regulation regarding the protection of state information resources, critical infrastructure facilities, mechanisms for responding to cyber incidents, and interaction between entities within the national cybersecurity system. Particular attention is paid to the analysis of international approaches, including the provisions of the EU NIS2 Directive, ENISA recommendations, NATO standards, and ISO/IEC standards in the field of information security.

The results of the study demonstrate that, under martial law, cybersecurity has become one of the key areas of ensuring national security of the state. At the same time, further improvement of legal regulation remains necessary, particularly regarding the delineation of powers among cybersecurity entities, strengthening the protection of critical infrastructure, improving mechanisms for exchanging information on cyber threats, and harmonizing Ukrainian legislation with European Union law.

It is concluded that effective legal regulation of cybersecurity under martial law requires a comprehensive approach, combining national protection mechanisms with international standards and developing a resilient system for responding to contemporary cyber threats.
