HYBRID THREATS AND THEIR IMPACT ON THE TRANSFORMATION OF INTERNATIONAL LEGAL NORMS

Abstract

The aim of this study is to conduct a comprehensive analysis of the nature of hybrid threats as a contemporary phenomenon in international relations, as well as to determine their impact on the transformation of international legal norms and security mechanisms. Particular attention is paid to the role of Ukraine’s experience in shaping new approaches to the legal regulation of hybrid aggression.

The study employs general scientific and specialized legal methods, including systemic analysis, the comparative legal method, the formal-legal approach, and the method of synthesizing scientific sources. An interdisciplinary approach is applied to the study of hybrid threats as a multidimensional phenomenon encompassing the military, informational, economic, and cyber spheres. Additionally, analytical data on the effectiveness of tools for countering hybrid threats are utilized.

It has been established that hybrid threats cause significant changes in international law, in particular the expansion of the concept of aggression through the inclusion of cyber operations and information influence. A transformation in approaches to state responsibility has been identified, necessitating the improvement of mechanisms for attributing actions in complex, multi-level conflicts. The growing role of international organizations in shaping collective security mechanisms and adapting strategies to new challenges has been demonstrated. The need to intensify the development of international humanitarian law in the context of non-traditional forms of conflict has been substantiated.

It has been determined that Ukraine’s experience in countering hybrid aggression has become an important factor in rethinking categories of international law and has contributed to the development of new approaches to the classification of aggression and liability. The effectiveness of the main countermeasures has been analyzed; among them, military deterrence and economic sanctions are the most effective, while international legal mechanisms require further improvement.

It is concluded that hybrid threats pose a systemic challenge to modern international law, driving its evolution and adaptation to new realities. The transformation of legal norms manifests itself in the expansion of the content of key categories, the development of accountability instruments, and the strengthening of the role of institutional mechanisms. The necessity of further developing universal international legal approaches to regulating hybrid conflicts, which will take into account their complex and dynamic nature, is substantiated.
