Abstract

This article analyzes the historical aspects of the formation of anti-smuggling mechanisms
in Ukraine. The author's approach of modern scientists in combating the investigated offenses
as a component of international cooperation in the regulatory and legal multilateral and organizational and legal aspect is noted. It is indicated that the given description of the legal instruments at the current stage of combating these offenses should be useful to the subjects of such activity.

It is noted that during the existence of the Criminal Code of Ukraine, many scientific developments and studies of the problem of criminal-legal regulation of smuggling and its prevention were carried out, but scientific developments of an interdisciplinary nature regarding the criminal-legal and criminological analysis of smuggling in Ukraine have not yet been carried out in domestic science. In addition, the outlined studies have not solved a number of fundamental tasks that have found their embodiment in the modern practice of criminal law regulation of the criminal offense provided for in Art. 201 and Art. 305 of the Criminal Code of Ukraine, its modern criminological characteristics, as well as effective mechanisms for countering this negative phenomenon.

It is noted that combating smuggling in Ukraine must also take into account an objective approach, which involves the need to study the reasons and conditions that provoke such an offense.In this sense, the judgment of scientists that the foundation of any study is generally philosophical approaches is significant: these are the basic principles, laws and categories of dialectics; it is also a systematic approach, which is the general scientific basis of every study, which makes its application indirect to the entire field of knowledge and one that is used in all areas of science, technology and management, which are necessary for the search for effective mechanisms to combat smuggling.

It is indicated that in international criminology, it is also partially believed that the unity of scientific research is best filled by a systematic approach.
