Abstract

Scholars focus on the problematic nature of the correlation between the mechanisms for implementing legal and religious prescriptions. To overcome this problem, it is necessary to clearly distinguish the functional orientation of religion and law, to find their common and distinctive features, and to establish the peculiarities of their interaction in religious and legal regulation.

The purpose of the study is to delineate the spheres of application of law and religion in the process of religious and legal regulation and to determine the nature of the relationship and mutual influence of legal and religious regulators of social relations.

In the course of the study and the formulation of its results, the author used general scientific methods of analysis, synthesis and generalization. The comparative method was used to establish the correlation between law and religion in religious and legal regulation.

The correlation between the mechanisms of implementation of legal and religious provisions is problematic and conflictual. Religion forms the ideological basis of human life. Only those social relations over which social and state control can be established are subject to legal regulation. Nevertheless, legal and religious regulators of social relations are currently in constant correlation. Religious principles of free will and the recognition of the individual as the highest social value have been embodied in European universal legal acts.

Being separate types of social regulation, legal and religious regulation interact to regulate social relations. Both law and religion are formalized social regulators.
