THE ROLE OF THE STATE IN THE FORMATION OF INVESTMENT SAFETY UNDER WAR CONDITIONS

Abstract

The paper is dedicated to issues of the determination of the role of the state in the formation of investment safety. There is stressed, under war conditions, investment policy has specific peculiarities and determines priority directions of the development of the sector of military-industrial complex. The last one is aimed at ensuring that the latest and most innovative means of warfare pass the necessary stages of testing, are adopted and put into production as soon as possible. At the same time, a support of specific private persons and enthusiasts, small enterprises and natural persons entrepreneurs is a very significant. There is outlined, the state provides a few functions in the context of the ensuring investment safety. Firstly, it is a regulative providing of the investment safety by the creation of appropriative legislative guarantees for investment activities. Secondly, it is a coordination of “private initiatives” aimed at resolving of issues of national security and strengthening Ukraineʼs defense capabilities in the context of the war with the Russian aggressor, in the field of activities of defense tech companies and private persons. Thirdly, it is a development of the national investment strategy for the period of the post-war reconstruction and development of the state. A complex of systematized legal norms aimed at the providing of appropriate activities of the investment sector of the national economy and counteraction to potential and existing hazards in this field has to be understood as a mechanism of providing of investment safety of the state. Mentioned above allowed to suggest to add a specific Part 9 to the Article 2 as following: “The state ensures the safety of investment activity through a set of political, regulatory, organizational and technical measures aimed at obtaining commercial and/or social benefits”.
