OPTIMIZATION OF THE SYSTEM OF SUBJECTS OF ADMINISTRATIVE AND LEGAL PROTECTION AND PROTECTION OF INTELLECTUAL PROPERTY RIGHTS IN UKRAINE

Abstract

The article is devoted to the optimization of the system of subjects of administrative and legal protection and protection of intellectual property rights in Ukraine. It is emphasized that the organizational component of the organizational and legal mechanism of promoting the protection and protection of intellectual property rights is represented by the bodies of all branches of government. The goal of ensuring the protection of intellectual property by administrative methods and means and observing the rights and legitimate interests of individuals during the protection of rights to intellectual property objects is close to the goal of the previous direction. Process It is emphasized that the administrative and legal protection of copyright and related rights is carried out by public administration entities that combine the activities of executive authorities, self-government bodies and institutions of civil society. At the same time, the process of optimizing the system of subjects of administrative and legal protection and protection of intellectual property rights in Ukraine was aimed at the implementation of specialization of administrative and legal measures in the field of maintaining law and order, established by the norms of administrative legislation in the field of intellectual property protection, and facilitating the implementation of legal protection by rights holders that is provided by the activity of subjects in the sphere of public activity. One of the areas of optimization is the improvement of the legislation regulating the field of intellectual property, with the aim of simplifying registration procedures and protection of rights to intellectual results. This may include improving application procedures, shortening the time frame for processing cases, and increasing liability for intellectual property rights violations. The optimization of the system of subjects of administrative and legal protection and protection of intellectual property rights in Ukraine is aimed at overcoming the problems of the distribution of counterfeit products and the application of a simplified procedure for the destruction of goods that contain signs of infringement of intellectual property rights.
