PROCEDURAL AND LEGAL FEATURES OF THE IDENTIFICATION AND TRACING OF ASSETS IN THE ACTIVITIES OF ARMA

The article is devoted to theissues of procedural and legal features of identifying and tracing assets in the activities of ARMA. It was emphasized that the National Agency of Ukraine for the Detection, Search and Management of Assets Derived from Corruption and Other Crimes (ARMA) is a newly created law enforcement agency with a special status, whose powers include the detection and search for assets that may be seized in criminal proceedings, as well as the management of these assets. The activity of the ARMA embodies the doctrine of "intelligence-led policing (ILP of the risk system)" in terms of identifying and tracing assets. It is emphasized that at the level of procedural legislation, aspects of identifying and tracing assets derived from corruption and other crimes are unfortunately not regulated. The ability to independently exercise its procedural powers to identify and search for ARMA assets can only be exercised through the use of such a tool as "requesting information to state bodies, local self-government bodies, in order to obtain information necessary for the performance of ARMA duties", the regulatory and legal procedure for the application of which is determined at the level of the Law of Ukraine "On the National Agency of Ukraine for the Detection, Tracing and Management of Assets Obtained from Corruption and Other Crimes" dated November 10, 2015 No. 772-VIII. The use of artificial intelligence software in the activities of ARMA to strengthen the ability to combine all its information resources into a single analytical and retrieval system that allows rapid processing and analysis of information in accordance with the specified parameters contained in automated information and reference systems, registers and data banks available to ARMA looks extremely promising.
