Abstract

The article examines the forensic characteristics of arbitrary occupation of a plot of land and arbitrary construction. The author states that the problems of investigating criminal offenses related to arbitrary occupation of land and arbitrary construction were the subject of research in the works of many domestic and foreign scientists. At the same time, significant changes in the state, structure and dynamics of these criminal offenses require a comprehensive scientific study of forensically significant information about the methods and circumstances of the arbitrary occupation of a plot of land and arbitrary construction, the subject of criminal encroachment, specific traces and consequences of the activities and inaction of officials, specially authorized persons, other persons and the development of a system of elements of the forensic characteristics of these criminal offenses, scientific methods, tactical techniques and recommendations aimed at the investigation of the specified criminal offenses.

It is emphasized that the forensic characteristics of criminal offenses occupy an important place in the methodology of investigation of certain types of criminal offences. This concept in criminology is a system of the most significant signs. The analysis of such signs, and even their interrelationship, allows to effectively reveal and investigate the committed criminal offense. The source of the forensic characteristics is the study and generalization of the experience of investigative and judicial practice, which allows in the investigative activity to single out the main elements that make up the model of the committed criminal offense.

It was concluded that arbitrary occupation of land and arbitrary construction are usually carried out by officials of enterprises, organizations and institutions and private entrepreneurs.
