SUBJECTS OF PUBLIC RELATIONS IN THE FIELD OF THE ACCESS TO THE PUBLIC INFORMATION

The paper is dedicated to issues on subject composition of public relations in the field of the access to public information. There is stressed, public information is a significant element of providing of openness and transparency of the authority as well as a means of providing of opportunity of the public control for activities of authority’s bodies. The right for access to public information is one of main principles of the democracy and a legal state. There is outlined, that not only residents of Ukraine can be inquirers, as legislation does not relate citizenship status or mandatory registration of a certain legal entity in Ukraine to the right for access to public information. Thus, we conclude that foreign citizens and non-resident legal entities can be include into the scope of inquirers. Entities that carry out professional activities in the field of using received public information and have a legally defined obligation to preserve it, ensure the confidentiality of received information can be inquirers of public information. It allows to suggest them more extended access to information resources, including information that signed certain restrictions. Information administrators are the subjects of the authorities which, as subjects of public relations in the field of the access to public information, are subjects of the administrative law, provided with power for the implementation of the public governance and administration. At the same time, a question of inclusion as a separate subject of public relations in the field of access to public information as a structural unit or person responsible for access to public information of administrators who are not endowed with a separate legal status (legal personality) for independent participation in relations of access to public information. Legal regulation in the field of the providing the right for access to public information provides fixation of positive duties of authorities and their officials regarding the dissemination and protection of public information; determination of ways of the disseminating such information and limits of its availability; establishment of responsibility for violation of rules on information availability.
