Abstract

The article examines the impact of the ratification of the Rome Statute of the International Criminal Court on the development of criminal legislation of Ukraine and analyzes the main problems of harmonizing national legal norms with international standards. The international legal principles of the functioning of the International Criminal Court are revealed, in particular the principles of complementarity, individual criminal liability and the absence of immunities for officials. The stages of Ukraine's integration into the system of international criminal justice are analyzed, including constitutional amendments, ratification of the Rome Statute and amendments to the Criminal and Criminal Procedure Codes of Ukraine. Particular attention is paid to the problems of implementing international crimes into national legislation,
in particular the issues of qualifying the crime of aggression, command responsibility, determining jurisdiction and proving international crimes. The practical challenges of interaction between national criminal justice bodies and the International Criminal Court and the need to increase the institutional capacity of law enforcement bodies and courts are highlighted. The need for comprehensive reform of the criminal legislation of Ukraine in accordance with the provisions of the Rome Statute and European legal standards is substantiated. It is concluded that the effective implementation of the norms of international criminal law is an important condition for ensuring the rule of law, the inevitability of punishment for international crimes and strengthening the international authority of Ukraine.
