MECHANISM FOR IMPLEMENTATION OF MEASURES FOR THE PREVENTION OF ROBBERY COMMITTED BY MINORS

Abstract

The article examines the mechanisms of implementation of measures to prevent robberies committed by minors. It is noted that the analysis of age groups of minors with the help of criminological indicators and sociological surveys shows that the level of criminal activity among persons aged 14–16 years is almost three times lower than in the group of 16–18 years. Juvenile delinquency often has a latent character, since most of their illegal actions are perceived as a manifestation of insufficient social maturity. In addition, juvenile delinquency is characterized by a high rate of recidivism, which is constantly increasing. Another feature is the group nature of juvenile delinquency, which allows them to compensate for psychological insecurity in their actions by combining physical efforts to achieve a criminal result.

The position has been expressed that bodies and services dealing with the protection of childrenʼs rights should perform general and specific tasks related to the special object of preventive influence in the juvenile justice system. The specific tasks of juvenile justice include protective, preventive, educational, restorative, rehabilitation and resocialization functions. One of the key special functions is resocialization, which involves restoring the social status of a minor serving a prison sentence to the level of a full-fledged member of society by restoring his physical, psychological and social condition (according to Part 2 of Article 6 of the Criminal Executive Code of Ukraine).

Peculiarities of social adaptation of released minors have the following characteristics.

It was concluded that despite the positive aspects of the introduction of probation in Ukraine, this institution of the criminal-executive system is actively developing. One of the directions of this development is the cooperation of probation authorities with public organizations in order to prevent recidivism in Ukraine. According to the results of our research, we have proposed a number of initiatives to improve the effectiveness of this cooperation in the field of prevention of recidivism of violent crime among minors.
