The article examines that economic reforms radically changed the national economy of Ukraine, which required a comprehensive revision of the concept of its criminal law protection.
The need to start work aimed at comprehensive reform of norms on economic crimes and their optimization is under consideration. It is necessary to ensure the adequacy of this system to the real needs of society regarding the legal protection of the national economy in general and the main institutions of the market economy – credit, investment, finance, the consumer market, economic competition, etc. This article offers a conceptual rationale for this reform.
It was found that the system of economic crimes had not previously been considered within the framework of a comparative legal study with similar systems of countries with
a developed market economy. Ukrainian legal literature previously did not provide a comprehensive description of the system of economic crimes in economically developed countries. In domestic literature, the issue of the emergence and development of the system of economic crimes in countries with developed economies was not previously considered, there were only fragmentary studies of individual legal norms.
It has been analyzed that the danger of many economic crimes is manifested in the undermining of public trust in market institutions. Public trust in credit is undermined – credit becomes expensive, destructive or unavailable. Distrust in investments leads to a fall in the price of securities and business activity – as a result, economic development stops.
The article examines how, within the framework of which relations and to what extent a criminal law ban can be useful and appropriate in the economic sphere – this is the main question of this research, which determines its relevance.
