Abstract

The article examines the key aspects of human rights in international law, guarantees of their observance and protection, as well as the concepts of international humanitarian law for today. It is important to distinguish between these concepts and correctly define the scope of their regulation. The relationship between international human rights law and international humanitarian law is studied. Particular attention is paid to normative legal acts that regulate the sphere of influence of international humanitarian law and international human rights law. The regional systems of international human rights law, which complement national and international human rights law regarding the protection and respect of human rights in certain regions of the world, are considered. There are three main regional human rights treaties that create human rights laws at the regional level. International human rights law and international humanitarian law have a close interaction with each other. Both provide, for example, protection against torture. They differ in that they regulate legally discrete structures, and usually work in different contexts and regulate different relationships. Generally, human rights regulate relations between states and individuals in the context of ordinary life, while humanitarian law regulates the actions of belligerent states and those actors with whom they enter into relations. The list of combatants is indicated; the concept of "combatants" is defined; the specified list of combatants defined by international humanitarian law; The international experience of creating special military tribunals: the Nuremberg Trials, the Tokyo Tribunal, the International Tribunal for the Former Yugoslavia and the International Tribunal for Rwanda is followed, and their significance for the development of international relations is investigated. The history of the creation of the International Criminal Court and the specifics of its activities are partially investigated.
