Abstract

The article examines certain features of the pre-trial investigation of criminal offenses related to human trafficking in the theoretical and practical plane. The relevance of the research topic is substantiated from the point of view of a significant increase in cases of criminal offenses related to human trafficking. The current criminal procedural legislation of Ukraine related to the pre-trial investigation of such criminal offenses is analyzed.

An analysis of the opening of criminal proceedings during the investigation of criminal offenses related to human trafficking as the first stage of the pre-trial investigation was carried out. It has been established that the most characteristic feature of the opening of criminal proceedings on the fact of human trafficking is the problem-situational nature caused by the latency of this criminal offense. The peculiarity of the pre-trial investigation of criminal offenses related to human trafficking is outlined, which is that at the time of entering information into the Unified register of court decisions, the composition of such a criminal offense as human trafficking may be ambiguously recognized and therefore an investigation of other criminal offenses may be initiated. which may be related to human trafficking. Investigative (search) actions and covert investigative (search) actions, which are most often carried out during the pre-trial investigation of criminal offenses related to human trafficking, are analyzed. The first group was divided into: detention and questioning of suspects, questioning of victims, questioning of witnesses, presentation for identification of suspects, searches, inspection of the scene of the incident. It was established that the main secret investigative (search) actions that are important during the investigation of these criminal offenses are audio and video monitoring of a person and observation of a person, thing or place. In addition, the article analyzes the examinations conducted during the investigation of such a group of criminal offenses. In particular, we believe that forensic medical, forensic psychological and forensic psychiatric examinations are most in demand.
