PROCEDURAL PECULIARITIES OF THE CIRCULATION OF INFORMATION THAT INCLUDES PERSONAL DATA

The paper is dedicated to issues on procedural peculiarities of the circulation of information that includes personal data. It is stressed, that the category of “personal data circulation” has to be identified on doctrinal and legal levels. It should include public relations on the collection, registration, keeping, usage, and extension of the information
that includes personal data, as well as deleting, destruction, and pseudonymization of personal data. It is suggested to understand pseudonymization as a deep (significant) depersonalization of personal data in the way of processing the personal data of a natural person. This way has to provide the impossibility of including personal data to the certain subject of data without the use of additional information, and in conditions of specifically keeping additional information and applying technical and organizational measures that prevent belonging to an identified natural person. However, taking into account a comprehensive regulation of public relations in the field of personal data, it is necessary to talk about procedural peculiarities of the circulation of information that includes personal data. These peculiarities are determined by the necessity of reflexing principles of legal regulation of these relations that are provided by personal data legislation, in procedural statements of both specific branches of law and interbranch institutions. These procedural requirements have to include procedural requirements for personal data protection in administrative-managemental, financial-tax, customs, economic-civil, criminal-procedural, labor relations, relations in the field of social protection, health care, military service, operative search, and counter-intelligence activities. The necessity of providing protection of sensitive information of a natural person in the way of strict adherence to legality, adequacy, accuracy, limitation integrity, and confidentiality of personal data, is a main peculiarity of these relations. Thus, in each field of public relations, has to be developed appropriate procedural requirements on the circulation of information that includes personal data, on the basis of basic legal requirements, provided by the specific law and regulation.
