Abstract

The article emphasizes that the investigative experiment should be distinguished from the experiment as a general scientific method of investigation, which is used as a cognitive technique during the conduct of individual investigative actions. The following experiment is a complete psychological measure of influence on its students, since the results obtained clearly testify to the possibility or impossibility of a certain phenomenon or event, and it is quite difficult to test them on suspects (accused). Therefore, a cold experiment is a necessary, and often irreplaceable way of checking and obtaining new evidence.

The article assumes that the experiment is one of the general scientific methods, which is an artificial, purposeful, repeatedly repeated under different, predetermined conditions, conducting a certain test or study. Its purpose is to confirm or develop an existing hypothesis regarding the nature of the phenomenon, its existence, possible ways of managing it, etc.

The article analyzes issues related to the grounds and procedural order of conducting an investigative (search) action – an investigative experiment. Attention is focused on the main reasons for conducting the next experiment, which include: 1) verification, clarification and obtaining new evidence; 2) establishment of a mechanism for committing a criminal offence; 3) verification of the possibility of implementation of certain facts or phenomena; 4) establishing the possibility of accepting any phenomena under certain conditions; 5) determination of the limits of information or ignorance of criminals about the crime event; 6) identification of the reasons and conditions that facilitated or hindered the commission of a criminal offense; 7) verification and evaluation of the released cooler versions; 8) establishment and elimination of contradictions in the statements of suspects, witnesses and victims; 9) verification and clarification of factual data obtained as a result of individual investigative actions, including investigative reviews, interrogations, recognition, etc.
